ONLINE STORE RULES

I. Initial provisions and company information

The below statute (hereinafter referred to as the “Regulations”) describes the rules and regulations of the online shop https://www.manufakturadobrowolscy.pl/ (further referred to as the “Store”). The Store’s administrator and owner is the company: Katarzyna Dobrowolska, Śliczna 30/26, Cracow (the given address is only the company registration address), tax number (NIP): 6562118750, e-mail: poczta@manufakturadobrowolscy.pl.

The Regulations define the rules for making purchases and sales contracts, as well as providing online services, including registration of new users via the store’s website at: https://www.manufakturadobrowolscy.pl/.

The store sells products via the Internet.

The sole right to run the store has the Katarzyna Dobrowolska company, referred to as the "Seller" in the further regulations.

All products offered in the store are new, free from physical and legal defects and have been legally put on the Polish market.

The photos and other forms of visualization and presentation of the products presented on the Store's website do not reflect its real size and are for information purposes only. We also inform you that the settings and size of the customer’s monitor affect the appearance of the products. This can cause differences especially in how the colour of the product is reflected.

Differences in the appearance of the products resulting from individual settings of the customer’s computer cannot be the basis for a complaint about the purchased products.

The products we manufacture are not waterproof.

All photos and descriptions presented in the Store are the sole property of the Seller or the Seller owns appropriate rights to them and they are protected by copyright.

Contact with the Store is possible via e-mail poczta@manufakturadobrowolscy.pl 24 hours a day, 7 days a week.

 

II. Account registration and placing orders

The Customer may place orders in the Store 24 hours a day, all days of the year. The fulfilment of the orders takes place on working days from Monday to Friday between 9:00 and 17:00. Acceptance for orders placed on Saturdays, Sundays and holidays takes place on the next business day.

Placing orders for products offered in the Store is possible after registration (purchase with registration) or without registration (purchase without registration). Both ways of placing orders are described in the following sections of the Regulations.

The condition for registering an account in the Store and making a purchase without registration is to read and accept the Shop's regulations and give consent to the processing of personal data by the Seller in order to provide services electronically. In order to confirm this fact, before setting up an account and before placing an order without registration, it will be necessary to mark the option "I have read the online store regulations and accept its content".

In order to register, select the "Register" tab on the website https://www.manufakturadobrowolscy.pl/, and then enter your data needed only for the execution of orders.

As a result of successful registration, the customer gets access to the account created for him, which he can use in the Store.

When making a purchase with registration, the customer places an order after logging into the Store, by adding the product presented in the Store to the cart. The customer can also log into his account after adding the item to the cart in the 2nd stage of ordering, after selecting the option "I already have an account in the store". Then, the customer can choose the payment and delivery method, as well as provide any comments to the order.

The customer interested in making a purchase without registration places an order by adding the product presented in the store to the cart, then selects the option "Purchase without registration", then enters details of the order, such as: customer name, address, telephone number, e-mail address, address of delivery if it differs from the first address, and other data necessary to issue a VAT invoice if the customer has selected the option to issue an invoice. After providing this data, the customer has the option to choose the method of payment and delivery and provide any comments to the order.

For both the purchase with and without registration after the customer provides all necessary data, a summary of the order will be displayed, including: description of the items ordered, unit price and total price of ordered items, the delivery method chosen by the customer along with its cost and the chosen method of payment, customer's details and address and data for issuing a VAT invoice, if the customer requested issuing such an invoice.

The ordering procedure ends, both when purchasing with and without registration, when the customer selects "I confirm the purchase". Performing this action results in placing an order and concluding a sale agreement with the Seller concerning the items covered by the order.

An email is sent to the e-mail address provided by the customer when ordering, confirming the sales contract with the Seller and confirming the acceptance of the order. In next steps the customer will also receive via e-mail current information regarding the progress of the order fulfilment.

The sales contract can be concluded only by an adult who has full legal capacity.

The store has the right to refuse to accept the order, or to request a prepayment if the order raises doubts as to the truth and reliability of the data provided.

 

III. Prices and payment methods

All prices are given in Polish złotys (PLN) and include VAT.

The prices given in products description do not include shipping costs.

Discounts that are given to customers do not merge. Only one discount code can be used for one order.

The price given for each product is binding at the time the order is placed by the customer.

Information on the total value of the order, including delivery costs, is displayed after the customer selects the payment method and the method of delivery of the order.

The Seller reserves the right to change the prices of products in offer, to introduce new products to the Store's offer, to carry out and cancel special offers on the Store's website or to modify them. The above does not affect orders placed before the effective date of the change of price, terms of special offers or sales. Such orders will be fulfilled according to the terms effective at the day of placing an order.

When making a purchase, the customer may choose the following forms of payment for the order being placed: payment on delivery - when collecting a parcel on delivery, or prepayment - payment by ordinary bank transfer.

 

IV. Methods and cost of delivery

Available and current methods and costs of delivery of products ordered in the Store are always presented on the Store's website. Delivery methods and costs are also displayed and available for customers to choose in "Your cart" tab before placing an order in the store.

The Seller reserves the right to change the costs of delivery and to change carriers, the services of which he uses to deliver orders placed in the Store, in the event of a change in delivery prices by carriers, the services of which the Seller uses. Such change does not apply to orders placed before the introduced change.

 

V. Receipts and invoices

Each completed order has a proof of purchase attached in the form of a receipt.

VAT invoice is issued at the express request of the customer, after providing all the data needed to issue an invoice. The customer may request invoice for a period of 7 (seven) days from the date of purchase of the products.

 

VI. Term of orders fulfilment

The fulfilment of the order should be understood as the delivery of ordered items to the customer or to a third party designated by him and other than the carrier.

The order is executed after the payment has been made, or after the customer chooses the option of payment on delivery.

If the customer selects the payment in advance for the order, it should be paid within 2 business days from the date of order. In the absence of payment by that date in accordance with Article 492 of the Civil Code of 23rd April 1964 (Journal of Laws of the Republic of Poland No. 16, item 93, as amended), the Seller may withdraw from the contract, and thus the transaction is deemed no longer valid and will be cancelled.

Preparation of the order to be sent is 5 or 10 working days counting from the moment of sending to the customer to the e-mail address (indicated by the customer when placing the order) information about receiving payment for the ordered items or from receiving information from the customer about the option of payment on delivery. Every watch’s description provides a date that describes when the watch can be sent by us. In special cases, the preparation of an order may take up to 30 (thirty) days. In this case, the customer will be informed via the e-mail address provided in the order about the extension of his order’s term of fulfilment.

 

VII. Complaints (due to statutory warranty)

The seller is liable to the customer (being a consumer due to the statutory warranty) for physical defects (non-compliance of the goods with the contract) and legal defects (for instance ownership or a thing encumbered by other property right) of products purchased in the store. This applies to defects that existed at the time of transferring the danger to the customer or result from the reason inherent in the sold product at the same time. The scope of the warranty is specified by the Civil Code of April 23, 1964 (Journal of Laws of the Republic of Poland No. 16, item 93, as amended) and other generally applicable laws, including the Act of 30 May 2014 on consumer rights (Journal of Laws of the Republic of Poland 2014 item 827).

The customer is entitled to the following requests: repair of goods, replacement of goods with the goods free from defects, price reduction, withdrawal from the contract.

Complaints can be submitted in any form. We prefer to file a complaint by email at: poczta@manufakturadobrowolscy.pl. In order to deal with the complaint efficiently, we recommend including the following data in the complaint: name, address, e-mail address, telephone number, subject of the complaint and order number, indicating the Customer's request, all circumstances justifying the complaint, date of defect, and if possible pictures of defects.

If the data or information provided in the complaint need to be specified, before considering the complaint the Seller will ask the person lodging the complaint to provide additional details to required extent.

If it is necessary to consider the complaint, the customer will be asked to return the product which the complaint concerns to the Seller at the following address: Katarzyna Dobrowolska, Śliczna 30/26, 31-444 Cracow.

The Seller shall immediately, but not later than within 14 (fourteen) days, respond to the customer's complaint and inform him of the manner of proceeding.

 

VIII. Product replacement

It is possible to replace the product purchased in the store.

Only products that have no signs of use can be exchanged.

Purchased product can be replaced only with other product from the same category and at the same price. If you wish to replace with a product from another category and / or at a different price, use the withdrawal option described in the next chapter: IX. The right to withdraw from the contract, and then place a new order in the store.

The wish to replace a product should be notified to the Seller by sending an e-mail to the following address: poczta@manufakturadobrowolscy.pl.

The items to be replaced should be sent back to the Seller's address: Katarzyna Dobrowolska, Śliczna 30/26, 31-444 Kraków.

The package should have the following information attached: name and surname, address to which the replaced product is to be sent, telephone number, e-mail address and order number, as well as information about chosen replacement product.

The cost of delivering the products for replacement to the Seller is borne by the customer, while the cost of delivery of the replaced items to the customer in the country is covered by the Seller. If the parcel is to be sent abroad, the Buyer should cover the cost of such shipment in accordance with the current delivery price list.

The replaced product will be sent within 7 working days after receiving the receipt of the item for replacement together with the necessary information listed in point 6.

 

IX. The right to withdraw from the contract

The customer who is a consumer has the right to withdraw, without giving any reason, from the sales agreement within 14 days from the day the products are handed over to the customer or a third party appointed by him other than the carrier, in accordance with the rules of the Act of 30 May 2014 on consumer rights (Journal of Laws of the Republic of Poland 2014 item 827).

To comply with this deadline, it is sufficient to submit a statement on withdrawal from the contract in any form before its expiration. In the case of a written form, the statement should be delivered to the Seller's address: Katarzyna Dobrowolska, Śliczna 30/26, 31-444 Kraków.

In the case of an electronic form, a statement should be sent to the following e-mail address: poczta@manufakturadobrowolscy.pl.

The customer can make such a statement himself. All one has to do is to put in the statement as much information as possible: name and surname, address, order number, e-mail address, phone number, Allegro nickname (if any), auction number (if any), account number to refund or information about the refund by postal transfer to the address provided.

If the customer has made a statement of withdrawal from the sales contract before the Seller accepted his offer, the offer ceases to be binding.

The right to withdraw from a distance contract is not granted to the consumer in cases of goods with properties specified by the consumer in his order or closely related to his person. This means that the Seller is not obliged to accept the return of goods made at the customer's request or modified at the customer's request.

In the event of withdrawal from the contract, the contract is considered null and void.

If the consumer withdraws from the sales contract as described above, he is obliged to return the products covered by the contract. The return should be sent to the address given in point 2 no later than within 14 days from the date of withdrawal from the contract.

The consumer is liable for reducing the value of the product as a result of using it in a way that goes beyond what is necessary to establish the qualities, characteristics and functioning of the product. In this case, the amount refunded may be reduced by the amount resulting from the reduction in the value of the returned item.

The customer bears the direct costs of returning the goods, i.e. the fee for the shipment of the returned product. This is the only cost associated with the return of things that the customer bears.

The Seller is obliged to immediately (no later than within 14 days from the date of receival of the Customer's statement on withdrawal from the sales contract) refund all payments made by him, including the cost of delivery, unless the customer did not carry such a cost.

If the Customer using the right of withdrawal has chosen the method of delivery of the goods other than the cheapest usual method of delivery offered by the Seller, the Seller is not obliged to reimburse the Customer for additional costs incurred.

The refund of the amount paid by the client, taking into account the objection from point 11, will occur at the customer's choice by bank transfer to the bank account number indicated or by postal transfer within 14 days from the date of withdrawal from the contract. Both ways of refunding the amount paid by the client do not involve any additional costs for him.

 

X. Personal data

In connection with the amendment of the rules of protection of personal data and the article of 25 May 2018 of Regulation of the European Parliament and Council of the European Union 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (Data Protection Directive), we would like to inform that:

The administrator of personal data is Katarzyna Dobrowolska conducting an economic activity under the name Katarzyna Dobrowolska based in Cracow, 30/26 Śliczna Street, 31-444 Cracow. Company contact details: e-mail poczta@manufakturadobrowolscy.pl.

The company processes personal data for the purposes of:

(1) providing the User's account service in an online store and making the online Watch Ordering System available to provide the product purchase service in the store, via the website www.manufakturadobrowolscy.pl. The legal basis for data processing is the fulfilment of the contract (Article 6 (1) (b) of the GDPR),

(2) the sale of products offered by the Store - the legal basis for data processing is the fulfilment of the contract (Article 6 (1) (b) of the GDPR),

(3) marketing - the legal basis for data processing is the legitimate interest of the Store - marketing of own products and services (Article 6 paragraph 1 letter f) of the GDPR),

(4) consideration of a complaint, investigation and defence in the event of mutual claims - the legal basis for data processing is the legitimate interest of the company - (Article 6 paragraph 1 point f of the GDPR),

(5) sending commercial information by electronic means - only if the User agrees. The legal basis for data processing is consent (Article 6 (1) (b) of the GDPR),

Providing personal data is voluntary, but necessary in order to conclude an agreement with the Store.

Personal data will be processed for the period necessary for the fulfilment of the contract, and after this period for the purposes and for the time and to the extent required by law or to secure any claims, or until the consent is withdrawn.

The recipients of personal data will be:

  • entities that provide and support the Shop's teleinformation systems to operate the website manufakturadobrowolscy.pl,
  • entities providing product delivery services.

Each person, to the extent required by law, has the right to access their data and to correct them, delete  them or limit their processing, the right to object to the processing, the right to transfer data, as well as the right to withdraw consent at any time. Withdrawal of consent does not affect the legality of the processing which was carried out on the basis of consent before its withdrawal.

In case of any doubts related to the processing of personal data, each person may ask the company for information. Notwithstanding the foregoing, everyone has the right to lodge a complaint with the supervisory body - the President of the Office of Personal Data Protection.

 

XI. Privacy policy and provision of services by electronic means

The Seller reserves the right to disclose selected information about his clients to the competent authorities or third parties who submit a request for such information, in accordance with the provisions of applicable law.

In cases other than those specified in point 1, your data will remain undisclosed to other entities.

The services provided electronically by the Seller are: keeping the customer account in the Store, sending e-mail information regarding the stages of order fulfilment to the customers, contact form, linking the Store's website with Facebook on the terms described in paragraphs 19 - 21 of this chapter of the Regulations. The seller does not charge any fees for their provision.

The minimum technical requirements to use the Store is at least Internet browser version: Internet Explorer version 9, Chrome version 16, Firefox version 10, Opera version 11, Safari version 5 or newer with JavaScript support and Internet connection.

The Contact Form service provides a functionality of sending a message to the Seller via the form placed on the Shop Website. Resignation from this service is possible at any time and consists in ceasing to send inquiries to the Seller.

The customer account in the store makes it easier to place orders, it allows you to view submitted orders and edit the data provided by the customer during account registration.

The process of setting up a customer account in the store is described in the Store's regulations in point 4 of chapter II. Account registration and placing orders.

You can also opt out of having a customer account at the Store at any time. For this purpose, it is sufficient to submit to the Seller an appropriate declaration of intent using any means of remote communication, enabling the Seller to become acquainted with the Customer's declaration of intent. In this case, we recommend contacting via the e-mail address of the Store: poczta@manufakturadobrowolscy.pl. Your account will be immediately, however, no later than within 14 days, removed from the system. Nevertheless, you will be able to create it in the future.

The seller provides the ability to link the Store's website with Facebook, that is available at www.facebook.com, owned by Facebook Inc. Company 1601 Willow Rd. Menlo Park, CA, 94025 USA.

The "Like" icon on the Store’s main page is a link to the Facebook and is used to join the "MD Wood" fan page on this portal. By clicking on the icon indicated, the Facebook receives information about your visit to our website and records the joining to the brand "MD Wood"’s fan page. If you are an account holder on this social network, your visit may be recorded and displayed on it. After clicking on the "Like" icon you will also have the option of entering a comment that will be displayed on the "MD Wood"’s fan page on Facebook.

The fan page of the brand "MD Wood" on Facebook contains information related to the brand, also provides the opportunity to enter comments, conduct discussions and ask questions, and allows participation in contests organized by the Seller.

The Seller is entitled to block access to the customer's account and other services provided electronically, in the event of the Customer acting to the detriment of the Seller or other Customers, violation of the law or the provisions of the Regulations by the Customer, and also when blocking access to the customer's account and other services provided electronically is justified due to security reasons, in particular: the Customer's breaching of the Online Store Website security or other hacker activities. Blocking access to the Customer's account and free services for the aforementioned reasons lasts for the period necessary to resolve the issue constituting the basis for blocking access to the Customer Account and free services. The Seller shall notify the Customer about blocking access to the Customer Account and free services by electronic means to the address provided by the Customer in the registration form.

By law, people using the services offered by the Store are prohibited to provide illegal content.

Complaints about services provided electronically should be directed to the Seller on the terms described in chapter VII. Complaints (due to statutory warranty).

The seller does not store data regarding his clients' payment or credit cards. This data is only processed by the electronic banking system enabling on-line payments.

 

XII. Final provisions

Information on goods presented on the Store's websites, in particular their descriptions and prices, constitute an invitation to conclude the contract specified in art. 71 of the Civil Code of April 23, 1964 (Journal of Laws of the Republic of Poland No. 16, item 93, as amended).

In matters not covered by the regulations, the provisions of Polish law apply, in particular the Civil Code of 23 April 1964 (Journal of Laws of the Republic of Poland No. 16, item 93, as amended) and the Act of 30 May 2014 on consumer rights (Journal of Laws of the Republic of Poland 2014, item 827).

The Seller shall be liable for not fulfilling or improper fulfilment of the contract, but in the case of contracts concluded with Clients being Entrepreneurs, the Seller shall be liable only in the event of deliberate damage and within the limits of actual losses by the Client being the Entrepreneur.

The Seller reserves the right to change the Regulations. The Seller will notify customers with registered customer accounts in the Store about any change in the Regulations. In the event that the Customer does not accept the new content of the Regulations, he is obliged to notify the Seller about this fact, which results in the termination of the contract for the provision of electronic services.

In the event of a change in the regulations, orders placed before the change to the Regulations will be implemented on the current terms.

The content of these Regulations may be recorded by printing, saving on an information carrier or downloading at any time from the Store's website.

In the event of a dispute arising out of the concluded Sales Agreement, the parties will endeavour to resolve the matter amicably. The law applicable to the resolution of any disputes arising from these Regulations is Polish law.

The buyer who is a consumer can also use the out-of-court method of dealing with complaints and pursuing claims before the Permanent Consumer Conciliation Court at the Voivodship Inspectorates of the Trade Inspection in Warsaw. Information on how to access the abovementioned mode and procedures for resolving disputes, can be found at the following address: www.uokik.gov.pl, in the tab "Settlement of consumer disputes".

These Regulations shall apply from December 13, 2018.
